ABOUT MOORE MARSDEN
The Moore/Marsden concept, which deals with the division of community property in California divorce proceedings, is based on two seminal California cases: In re Marriage of Moore (1980) and In re Marriage of Marsden (1982).
According to the Moore/Marsden concept, the community may acquire a financial stake in a spouse’s separate property, such as a home, when community funds are utilized to purchase it. The amount of community funds provided and the duration of the property’s ownership during the marriage define this interest. In general, all property acquired during a marriage is covered by the principle.
